A public hearing will be held before the Town of Victor Zoning Board of Appeals on Monday, July 1, 2013 at 7:05 p.m. at the Victor Town Hall, 85 East Main Street, Victor, New York, to consider the application of Shive-Hattery, ATTN: David Tepen, 1701 River Drive, Suite 200, Moline, IL, for an area variance to the Town of Victor Lighting Code (see Chapter 131-9 B (3), 131-11 P (3), 131-11 P (5), 131-8 C) to allow directional lighting to be aimed at an angle above 45 degrees above NADIR, to allow decorative lighting to be aimed at an angle above 45 degrees above NADIR, to allow the maximum illumination from illuminated features internal to a building to exceed one foot candle as measured, in all orientations, three feet above the ground, 20 feet away from the building and that luminance from windows must not originate from neon, LED’s, tubular lamps, luminous gas filled tubes and channel light fixtures. The property is zoned Commercial and is owned by Von Maur.
