A public hearing will be held before the Town of Victor Zoning Board of Appeals on Monday, August 19, 2013 at 7:05 p.m. at the Victor Town Hall, 85 East Main Street, Victor, New York, to consider the application of United Refining Company of Pennsylvania, ATTN: Mr. Alan Kolb, 11 Bradley Street, Warren, PA, for an area variance to the Town of Victor Zoning Code (see Section 211-31 Schedule II – Area & Height Requirements, Section 211-22 B (1)(b)[11, 15, 16], and Section 211-22 C (3)) to allow a reduction in the front setback to 10 feet to the canopy and a 64 foot front setback to the retail building whereas 80 feet is required, to allow a reduction in the rear setback to 10 feet to the retail building and a 59 foot rear setback to the canopy whereas 60 feet is required. The commercial zoning district has specific requirements under which a gas station is allowed. Section 211-22 B (1)(b) requires that entrances and exits align with other streets or at least 150 feet from the nearest intersection. Section 211-22 B(1)(b) requires that fuel tanks are placed at least 40 feet from street or lot lines. The applicant proposes 5 feet from the side lot line and 36.88 feet from the street line. Section 211-22 B(1)(b) requires that gas pumps are required to be at least 40 feet from street and lot lines. The applicant proposed 20.75 feet from the street line. Section 211-22 C (3) requires 35% green space. The applicant proposes 29.2% green space. Also under consideration is a waiver to the Sprinkler Code (see Section 83-4 F(2)(a) for a 1,250 square foot building. The property is located at 7453 State Route 96. The property is zoned Commercial and is owned by the applicant.
