[ARCHIVED] Town Zoning Notice of Public Hearing

LEGAL NOTICE

A public hearing will be held before the Town of Victor Zoning Board of Appeals on Monday, October 7, 2013 at 7:05 p.m. at the Victor Town Hall, 85 East Main Street, Victor, New York, to consider the following applications:

1. The application of Wilmorite Inc., ATTN: Jim McKenna, 1265 Scottsville Road, Rochester, New York for a waiver to the Town of Victor Sprinkler Code (see Chapter 83-4 F(2)(c)[2]) to allow the construction of a 2,880 square foot greenhouse that will be located closer than 100 feet to another structure and is over 1,000 square feet. The property is located at Eastview Mall on State Route 96, is zoned Commercial and is owned by the applicant.

2. The application of Gardner Construction Development, LLC, ATTN: Keith Gardner, 6551 Anthony Drive, Victor, New York, for an Area Variance to the Town of Victor Zoning Code (see Section 211-23 D (6), 211-32 (d)[1][a] & Schedule II, Area & Height Requirements) to allow the construction of an addition and lean-to to the existing property. The lean-to will be located approximately 37.5 feet from the rear property line whereas 60’ is required. The applicant had previously requested and was granted a rear setback variance of 50’. A 100’ landscape buffer is also required when a Commercial/Light Industrial district abuts a residentially zoned district. Also parking is shown closer than 80’ to the road. The property is zoned Commercial Light Industrial and is owned by Hunter Machine.
