FISHERS FIRE DISTRICT
NOTICE TO BIDDERS

NOTICE IS HERBY GIVEN that sealed bids are sought and requested by the Fishers Fire District, Fishers, New York, according to plans and specifications for the Fishers Fire Station No.2 Addition & Renovations located 380 High Street , Victor, NY 14564, as prepared by HBT Architects, 16 South Main Street, Pittsford, New York 14534.

Separate bids will be accepted for General Construction, HVAC, Plumbing, and Electrical work as set forth in the Contract Documents. In case a bidder proposes to furnish any other services, equipment, accessories or items of equipment in substitution for the particular make, number or size of items, accessories, equipment or services named in the plans and/or specifications, the bidder must clearly describe such service, equipment, accessory or item so that its' capacity or function may be clearly understood and considered by the Board of Commissioners as set forth in the specifications.

There will be a pre-bid meeting Tuesday March 4, 2014 at 10:00 am prevailing time at the site, 380 High Street, Victor, NY 14534. Attendance is not mandatory.

Sealed bids will be received by the Fishers Fire District at the offices of the HBT Architects, 16 South Main Street, Pittsford, NY 14534. Bids are due by 5:00 pm prevailing time, Tuesday March 18, 2014. At 7:00 pm the same day all bids will be publicly opened and read aloud at Fishers Fire Station No.2, 380 High Street, Victor, NY 14564. The enclosure containing the proposal shall have endorsed on the outside thereof, the name of the bidder, the business address to which communications may be sent and the title of the work, and the wording "SEALED BID" for which the proposal is made. Bids must be accompanied by a certified check made payable to Fishers Fire District, or a bid bond in an amount not less than five percent (5%) of the amount of the bid.

No bidder may withdraw their bid within ninety (90) calendar days after bid opening. Any bid may be withdrawn prior to the time for the opening of bids. Checks of unsuccessful bidders or bonds of unsuccessful bidders shall be returned within fourteen (14) days after the award of the contract or the rejection of all bids. The check or bond of the successful bidder(s) shall be held until the delivery of a signed contract, the check or bond shall then be returned as soon as practicable. In the case of the failure to execute the contract and to furnish any performance bond required in the specifications and/or plans, the check or bond shall become the property of the Fishers Fire District. The successful bid(s) shall be subject to the Fishers Fire District obtaining a successful permissive referendum for this project in whole pursuant to all applicable laws of the State of New York.

A maximum of one (1) set of Bid Documents and Drawings may be obtained by each bidder for a deposit of $60.00. Contact Documents will be available from the Rotolite-Elliott, 1 Grove Street #123, Pittsford, NY 14534. The Contract Documents will be available on or after February 25, 2014. The deposits will be refunded upon return of complete sets of Bid Documents and Drawings. Deposits will not be refunded beyond (30) days from the bid due date. Pdf files on disk will also be available however the $60.00 deposit will be non-refundable. Deposit checks shall be made payable to the Fishers Fire District. If Bid Documents are to be mailed, a non-refundable separate check for $40.00 made payable to Rotolite-Elliott is required.

When requesting Bid Documents, a prospective bidder must provide the Rotolite-Elliott with the firm's name, telephone number, fax number and email address. Drawings and Contract Documents may be examined at F. W. Dodge/McGraw Hill, 320 North Goodman Street, Rochester, New York 14607 and Builder's Exchange, 180 Linden Oaks, Rochester, New York 14625.

Bidders shall not include sales and compensating use taxes in the cost of materials that are to be incorporated into this project. All work under this Contract shall comply with all applicable ordinances, regulations, codes, and laws, and with all rules of the State of New York Department of Labor. This is a State of New York "Prevailing Wage Rate" project.

The Board of Commissioners reserves:
1. The right to examine and/or investigate any bidder as to the bidder's capacity to perform the work in accordance with the terms of the bid, specifications of the Board and this Notice;
2. The right to reject any and all bids;
3. The right to award the contract(s) to the lowest responsible bidder(s), but, in case two or more responsible bidders submit identical bids as to price, complying with the specifications and this Notice, the Board of Commissioners may award the contract to any or either of such bidders;
4. The right to waive any informality;
5. The right to examine and consider the bids received for a period of thirty (30) days after the opening thereof;
6. The right, in the case, where the bidder proposes to furnish any other service, equipment, accessory or item of equipment in substitution for the particular make, number or size of service, accessory or item of equipment named in the specifications, to consider whether, in its' sole judgment, such substitute or substitutes shall meet its' requirements and the judgment of the Board of Commissioners shall be considered final.
