LEGAL NOTICE

A public hearing will be held before the Town of Victor Zoning Board of Appeals on Monday, September 15, 2014, at 7:05 p.m. at the Victor Town Hall, 85 East Main Street, Victor, New York, to consider the following applications:

1. The application of Jonathan Freidlander Barn, 657 Old Dutch Road for an Area Variance to the Town of Victor Zoning Code (see Section 211-31G(2)) to allow a 1440 square foot two story barn to be constructed forward of the front line of the primary structure, whereas no accessory structure shall be forward of the front line of the primary structure. The property is zoned R-2 Residential and is owned by the applicant.

2. The application of Panera Bread, 7651 NYS Route 96 for Area Variances to the Town of Victor Zoning Code (see Section 211-22A (7) (a) [4] [c]) to waive the required 5’ landscaped buffer;
an Area Variance to the Town of Victor Zoning Code (see Schedule II, Area and Height Requirements) to allow lot depth of approximately 174’, whereas the lot is required to be 200’ in depth;
an Area Variance to the Town of Victor Zoning Code
(see Schedule II, Area and Height Requirements) to allow a 55’ front setback, whereas 80’ is required; an Area Variance to the Town of Victor Zoning Code (see Schedule II, Area and Height Requirements) to allow a rear setback of 25’ to the ATM drive through, and rear setback to the restaurant of 50’, whereas 60’ is
required for both; an Area Variance to the Town of Victor Zoning
Code (see Section 211-32A(2)( c)[1][a]) to allow parking 3’from the right-of-way, whereas 80’ is required; an Area Variance to the Town of Victor Zoning Code (211-32A (2) ( c) (1) [b]) to allow 0’ setback for parking and paved areas from side and rear property lines, whereas 5’ is required; an Area Variance to the Town of Victor Zoning Code (211-32A(2)(a)[1]) to allow the drive aisles to be less than the required 26’. The property is zoned C Commercial and is owned by West Hollow, LLC.

3. The application of Kenneth Weigert, 6836 County Road 41 for an Area Variance to the Town of Victor Code (see Section 211-27.3,
Density Overlay Districts) to allow a subdivision of 8.2 acres into
3 lots, the existing house and 2 additional lots, whereas, the parcel is located in a R-2 zoning district and the A Overlay Density District. The A Overlay Density District only allows subdivision into 2 lots, whereas at least 9 acres would be required. The property is zoned R-2 Residential and is owned by the applicant.

4. The application of Eric Orban, 7665 Modock Road, Victor, New York for a modification to an existing area variance to the Town of
Victor Zoning Code (see Section 211-31G (2)) to allow a 2500 square foot garage to be placed forward of the front line of the existing structure, whereas no accessory structure shall be forward of the front line of the primary structure. The property is zoned
R-2 Residential and is owned by the applicant.

5. The application of Day Automation and Greenway Developers, LLC., 7931 Rae Boulevard, Victor, New York for an Area Variance to the Town of Victor Zoning Code (see Section 211-24D(7)) to allow a 1730 square foot shipping and receiving building to be placed 54’ from the easterly boundary line being the district zone line between Light Industrial and Residential districts, whereas 100’ is required; an Area Variance to the Town of Victor Zoning Code (see Section 211-24D(11)), to allow a 54’ vegetative buffer between an industrial zoned lot and a residential zoned lot, whereas a 100’ vegetative buffer is required. The property is zoned Light Industrial and is owned by Greenway Developers, LLC.

6. The application of Michael Ferraro, 6937 Proximity Lane, Victor, New York, for an Area Variance to the Town of Victor Zoning Code (see Section 211-19 C) to allow a 1040 square foot shed to be placed 3’ from the side property line and 3’ from the back property line, whereas 15’ is required for side and rear setbacks. The property is zoned R-2 Residential and is owned by the applicant.

7. The application of Laura Chan, 1267 Malone Road, Victor, NY 14564 for an Area Variance to the Town of Victor Zoning Code (see Section 211-31G(2)) to allow a 14’ x 40’ shed to be placed forward of the front line of the primary structure, whereas no accessory structure shall be forward of the front line of the primary structure. The property is zoned R-2 Residential and is owned by the applicant.
