LEGAL NOTICE

A public hearing will be held before the Town of Victor Zoning Board of Appeals on Monday, March 18, 2013 at 7:05 p.m. at the Victor Town Hall, 85 East Main Street, Victor, New York, to consider the following applications:

1. The application of Jonathan & Patricia Gadsby, 6010 Calm Lake, Farmington, New York, for an area variance to the Town of Victor Zoning Code to allow an accessory structure (shed) on a vacant lot located at 8082 Oak Canyon Drive whereas no principal structure is located. Section 211-19A(3) indicates that accessory structures, like storage facilities, are allowed providing that they are the subordinate structure on the property. The property owners are planning to build a house on the lot in the near future. The property is zoned R-2 Residential is owned by the applicants.

2. The application of Shive-Hattery, ATTN: Andrea Aggertt, 2103 Eastland Drive, Bloomington, IL, for an area variance to the Town of Victor Sign Code (see Chapter 165-5 B (3) & (4)) to replace the Bon Ton signs that were placed on the Eastview Mall facades on the north (near the main entrance adjacent to JC Penney’s) and the east (near Bonefish Grill). The code indicates that signs are limited to the size of the frontage of the building to which the business is a tenant and that only two elevations are allowed to have a sign displayed providing that those two elevations face a road or public way. The signs proposed are for the new Von Maur store located at Eastview Mall. The property is zoned Commercial and is owned by Von Maur.
